Terms of Service

Version 2026-10-06 · Applies to the United States invitation-only beta.

These Terms are an agreement between you and DiskDrive.ai (“DiskDrive,” “we,” “us,” or “our”), operated from 231 Nixon Drive, Guntersville, Alabama 35976, USA. By creating an account or using the service, you agree to these Terms and acknowledge the Privacy Policy.

Eligibility and beta access

You must be at least 18 years old, located in the United States, legally able to enter this agreement, and invited to participate. Invitations are personal and may be revoked. You must provide accurate information, protect your credentials, and promptly report suspected compromise. You are responsible for activity by AI apps and source connections you authorize.

Your content

You retain ownership of content you store. You grant DiskDrive and its service providers a limited, non-exclusive license to host, reproduce, process, index, transmit, export, and delete that content only as needed to provide, secure, support, and improve the service or comply with law. You represent that you have the rights and permissions needed to submit the content.

AI apps and connected services

AI apps act as clients under the permissions you approve. Review each request and revoke connections you no longer trust. Third-party AI, storage, payment, and source providers have their own terms and privacy practices. DiskDrive does not control their output, availability, or independent use of information you send directly to them.

Acceptable use

You may not use DiskDrive to:

  • violate law or another person’s rights;
  • store or distribute malware, stolen credentials, or illegal content;
  • harass, exploit, impersonate, defraud, or harm others;
  • bypass authorization, quotas, rate limits, or security controls;
  • probe other accounts or interfere with service operation;
  • resell access without written permission; or
  • use private-beta features for anonymous public upload, hotlinking, or file-sharing services.

Plans, trials, and payment

Beta features and limits may change. If a paid subscription is offered, the price, billing interval, trial terms, and taxes are shown before you confirm Stripe-hosted checkout. Subscriptions renew automatically until canceled. You may cancel through the billing portal; cancellation stops the next renewal and access continues through the current paid period. Except where law requires otherwise, completed charges are not automatically refundable, but support may issue a discretionary refund. DiskDrive does not currently charge usage overages.

Service availability and backups

DiskDrive is a beta service. Features, limits, compatibility, and availability may change, and interruptions or data loss may occur. It is not sold as your sole backup system. Keep independent copies of critical content. We may modify or discontinue a feature after reasonable notice when practical.

Suspension and termination

You may export data and request account deletion through Settings. We may suspend or terminate access to investigate abuse, protect the service, comply with law, address nonpayment, or respond to a material breach. We will provide notice when reasonably practical. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, and dispute terms—remain effective after termination.

Disclaimers

To the maximum extent allowed by law, the service is provided “as is” and “as available.” DiskDrive disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free service, permanent compatibility with any AI app, or the accuracy of AI output. Some jurisdictions do not allow certain disclaimers, so they may not apply to you.

Limitation of liability

To the maximum extent allowed by law, DiskDrive will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data. DiskDrive’s total liability arising from the service will not exceed the greater of $100 or the amount you paid DiskDrive during the 12 months before the event giving rise to the claim. These limits do not apply where they are prohibited by law.

Indemnity

To the extent allowed by law, you will defend and indemnify DiskDrive against third-party claims arising from content you submit, your violation of these Terms, or your unlawful use of the service. This obligation does not apply to claims caused by DiskDrive’s own unlawful conduct.

Governing law and disputes

Alabama law governs these Terms without regard to conflict-of-law principles. Any dispute must be brought in a state or federal court with jurisdiction in Marshall County, Alabama, and each party consents to that venue. Nothing here prevents either party from seeking urgent injunctive relief or using an eligible small-claims process. We have not added mandatory arbitration or a class-action waiver to these beta Terms.

Changes and notices

We may update these Terms as the beta changes. Material changes will receive a new version and effective date and, when appropriate, require renewed acceptance. Notices may be delivered to your account email or within the service. If you do not agree to a change, stop using the service and request account deletion.
